BartkoZankel E’Discovery Practice Group Attorneys Michael Abraham and Howard Miller Join the Sedona Conference®

Attorneys Michael Abraham and Howard Miller of the e’Discovery Practice Group at the law firm of BartkoZankel have joined The Sedona Conference’s Working Group on Electronic Document Retention and Production (WG1). Both attorneys are committed to the development of principles and best practices recommendations for electronic document retention and production.

“WG1 is not only a leading source of information, but an effective forum for e'discovery practitioners to share their experiences and work collaboratively to develop and promote best practices in this dynamic practice area,” said Mr. Abraham, head of BartkoZankel’s E’Discovery Practice Group.

Mark Seo, manager of e’discovery and litigation technologies for the e’discovery practice support division of BartkoZankel, BZresources, also reported back from the EDRM Conference in St. Paul, Minnesota, that progress is being made in the formulation of production standards, and that BZresources has adopted many of those standards and will continue to be involved in the thought behind them as they evolve. “While the new standards are not set in concrete, they represent a significant move toward establishing a standard for production inside the legal community,” added Mr. Seo. “The adoption of a consistent standard would lead to greater precision in e’discovery.”

BartkoZankel's e’discovery practice group evolved out of the firm’s many years of Electronically Stored Information ("ESI") intensive anti-trust and other complex business litigation.

The combination of up-to-date analysis from BartkoZankel counsel who stay abreast of e'discovery developments as they affect legal representation; a highly-skilled litigation support staff which has won a national award for its use of technology at trial; and the experience and capacity to manage both onshore and offshore document reviews, has created a scalable talent pool that can be drawn upon appropriately by the firm for any particular dispute.

Because of BartkoZankel’s own success with the management of e'discovery as direct counsel, the firm has begun offering its litigation support division, BZresources, on a selective basis directly to other law firms and businesses.

In 2008, BartkoZankel won an important anti-trust case that was one of the significant criminal trials of the year, United States of America v. Gary Swanson (CR- 06-0692 PJH), due in part to the sophisticated and thorough document review system the firm’s in-house technology team used to manage millions of pages of electronic and hard copy material that were produced by the government, along with 1000s of hours of videotaped depositions.
