The case centered on a child who was born on October 16, 2002 at the defendant hospital. The mother of the child had an uneventful pregnancy, and she was admitted to the hospital on October 15, 2002 according to court documents. The next morning at 9:15 a.m. led to an intern noticing that there was thick meconium present and a non-responsive fetal heart rate, and the child was born an hour later according to the statements and allegations contained in the court pleadings.
When the child reached six years of age, the plaintiff was ultimately diagnosed with several conditions that included deficits in expressive language, visual attention, auditory attention, visuospatial construction, verbal memory and lung damage, according to court documents. The case was ultimately settled out of court.
