New York Birth Injury Lawyers Agree to $375,000.00 Settlement on Behalf of Client Family Who Lost a Baby to Meconium Aspiration Syndrome

This New York birth injury lawsuit was filed in the Queens County Supreme Court and it was assigned a case number of A08113. The defendant in the lawsuit was New York Presbyterian Hospital. The case alleged that the child of the client family died after birth because of meconium aspiration syndrome and that the defendant hospital did not properly care for the infant, thereby leading to the death of the child.

According to court documents, the mother of the child reported to the defendant hospital at approximately 5 p.m. on October 12, 2007 complaining of severe labor pains and leakage of blood-tinged amniotic fluid. These complaints surfaced after the mother had experienced what court documents described as an 'uneventful' pregnancy. 

The mother was examined and was told that she was only 2 centimeters dilated. She was given a fetal heart monitor and at 9 p.m., according to court documents, the infant's heart rate dropped. The mother was taken to an operating room and a C-section birth was performed. The child was born at approximately 9:30 p.m. but it did not cry after being extracted from the womb. 

The child was rushed to NICU after being cleaned and at 10 p.m., according to court documents, doctors told the mother that the baby had died because of meconium aspiration syndrome. The New York birth injury lawyers at Fitzgerald & Fitzgerald filed a lawsuit against the hospital and alleged that defendant hospital departed from good and accepted medical practice in the care of the infant in failing to properly monitor fetal heart rate, failing to timely respond to the infant's nonreassuring fetal heart rate, and failing to timely deliver the infant in light of the presence of meconium and the infant's nonreassuring fetal heart rate. The case has settled and is now closed.
