In regards to the additional products, we have a skin installed and we have a product that we had custom developed for us that connects to a PostgreSQL database. We've looked at slow PostgreSQL queries causing problems and have not been able to find an issue. PUYALLUP, Wash., Aug. 8 /PRNewswire/ -- Qwizdom, Inc., one of the nation's leading developers of audience response systems, has settled a lawsuit with eInstruction Corporation regarding US Patent No. 6,895,213 (the "'213 patent"). In the suit, eInstruction alleged that Qwizdom infringed certain claims of the '213 patent, and Qwizdom asserted that the patent was invalid. The '213 patent issued on May 17, 2005, years after Qwizdom implemented the feature in dispute, which Qwizdom now considers obsolete among its product line. The lawsuit is of public record as case number 6:05cv470, in the U.S. District Court for the Eastern District of Texas, Tyler Division. All claims in the suit are to be dismissed.
Darin Beamish, President of Qwizdom, said, "Most importantly, we want to ensure all of our customers that we will continue to provide the highest quality customer support for all of our products, new or old, and continue to deliver the most advanced audience response technology to market."
Mr. Beamish further indicated that, "We're pleased that the lawsuit is settled. Although we respect the intellectual property rights of others when they are valid, we did not agree that the eInstruction '213 patent was valid. However, there was no need to continue disputing the obsolete product feature at issue in the lawsuit." Qwizdom felt that the feature at issue was a shared display feature for use by students in tracking personal progress that Qwizdom had used with its older Q3 product. Qwizdom's new, more advanced products, have private dedicated displays that allow users to track their personal progress privately.
Qwizdom had stopped manufacturing its older infrared Q3 product in mid- year 2005 and began phasing it out even before the eInstruction lawsuit was initiated, and before Qwizdom's recent settlement with Fleetwood Group. Mr. Beamish expressed that, "Quite frankly, we feel that the disputes surrounding our infrared Q3 product could have all been settled much earlier, due to the fact that the Q3 was being phased out as a result of declining market demand, which has instead shifted to our new advanced radio frequency products, the Q4 and Q5."
Mr. Beamish did note, however, that, "If customer demand in the future changes again, we can develop a new infrared system with an even better price point. Our settlement with eInstruction does not impose restriction on that. But at present, we just don't see that demand and our radio frequency products continue to outperform in the marketplace."
