Bearish Stocks Trend Analysis: Tesla Motors Inc, Apple Inc, J.C. Penney Company, Oculus Innovative Sciences, Mosaic Co

The National Highway Traffic Safety Administration announced on November 19 that it was opening an official investigation into Tesla Motors Inc (NASDAQ:TSLA) two battery fires in its electric vehicles, and two weeks later, the agency is now asking that Tesla hand over all of its data on battery fires.

According to The Detroit News, the NHTSA requested in a letter dated November 27 that Tesla turn over detailed records of all consumer complaints, field reports, warranty claims, and property damage claims. The agency wants the results of tests, surveys, stimulations, and other efforts to review the battery fires and presumed defect, and it wants to determine whether Tesla has worked to make any changes to the electric vehicle to further prevent any future issues.

The data request is standard practice for the NHTSA as it works to finish its investigation. Still, the move shows which records officials are interested in going over to determine whether Tesla's Model S is at fault or if the two fires in five weeks occurred because of uncontrollable circumstances.

Wells Fargo doesn't think the double-digit comp growth shown by J.C. Penney Company, Inc.(NYSE:JCP) is as impressive as some are making it out to be. A look at the two-year stack of comparable store sales shows November was down 27.3% which is only a minor improvement over Q3's 29.6% decline. With J.C. Penney's cash burn rate still at a formidable level, the question still remains: Will Q4 sales accelerate fast enough?

Oculus Innovative Sciences, Inc.(NASDAQ:OCLS) more than doubles, rising 100%.The company announced a scar management 501(k) clearance for HydroGel. David Faber reports Carl Icahn's Apple Inc.(NASDAQ:AAPL) buyback proposal calls for "at least" $50B in share repurchases in FY14 (ends Sep. '14).As a "precatory" proposal, the resolution won't be binding even if a majority of Apple shareholder votes are cast in favor of it. Meanwhile, Time has published an Icahn cover story that focuses on his Apple efforts. Icahn tells the magazine he filed his proposal on Nov. 26 (thus making it eligible to be voted on at next year's shareholder meeting), and that he remains a supporter of Tim Cook. Icahn: "A lot of people say Steve Jobs probably wouldn't have talked to me, and maybe that's true ... But I think [Cook] found our conversation sort of interesting.
