ST. LOUIS, Jan. 30, 2014 /PRNewswire/ -- Professor Robert E. Morley, Jr. and REM Holdings 3, LLC, today filed a complaint against Square, Inc., Jack Dorsey, and James McKelvey, Jr. The complaint relates to breach of a joint venture agreement, breach of fiduciary duty, unjust enrichment, and other torts arising from the defendants' conduct during the creation of Square's business.
Dr. Morley's complaint details his role in designing the Square reader and co-founding the business, until he was cut out of the business by Messrs. Dorsey and McKelvey. The complaint also alleges Square's infringement of a credit card reader patent on which Dr. Morley is the sole inventor.
The complaint was filed by Caldwell Cassady & Curry, a national leader in high stakes intellectual property and commercial litigation. Caldwell Cassady & Curry are joined by noted St. Louis firms Sandberg Phoenix & von Gontard and Poster Liedler Woodruff & Lucchesi.
"This is exactly why we have a court system in place," said Austin Curry, Principal at Caldwell Cassady & Curry. "It is imperative that Dr. Morley and his company are properly compensated for his role in founding Square and fostering the growth that led it to where it stands today."
"Beyond inventing the Square card reader, Dr. Morley's role in the development and success of Square is highly significant. He was the only founding member who brought to the table a deep expertise in the credit card industry and credit card reader technology," said Brad Caldwell, Principal at Caldwell Cassady & Curry.
