Zelle Hofmann Launches E-Discovery and Information Governance Practice

Zelle Hofmann Voelbel & Mason LLP announces the launch of a new practice group providing E-Discovery and Information Governance legal services to clients both domestically and internationally.

The practice group will be led by Eric P. Mandel, National E-Discovery Counsel at Zelle Hofmann, and Charles R. Ragan, who has joined the firm as Special Counsel. Both are established leaders in the development of the law, technology and processes required to meet the marketplace demands for E-Discovery and Information Governance services.

“E-Discovery has become a mainstay of large-scale litigation, and is a major part of the discovery process. The volume of electronic information our clients and adversaries maintain has grown exponentially,” said Thomas Cook, a member of the firm’s Executive Committee. “Through this practice group, combined with our existing and proven legal technology platform, the firm is positioned to help clients control and manage the complexity and costs of E-Discovery. This will help us reduce our clients’ risk, minimize E-Discovery spend, and find the relevant electronic information that advances the ball in litigation.”

“Over the last several years, there has been a growing movement in the legal marketplace to bifurcate litigation services between traditional Trial or Merits Counsel, and Discovery Counsel,” notes Mandel. “As Discovery Counsel, our primary focus is in preventing runaway discovery costs, and using state-of-the-art technology and processes to provide Merits Counsel with the best available evidence to prosecute or defend each case.”

The Information Governance side of the practice will focus on assisting organizations in proactively establishing and maintaining proper policies to effectively manage the creation, storage, security, use, reuse and timely disposition of documents and ESI. Working with key corporate stakeholders, the firm will assist clients in maximizing the value of information and data, while controlling and reducing the associated costs and risks.

Members of this practice group will also be available to serve as expert witnesses, assisting parties and courts in determining the reasonableness of E-Discovery and Information Governance related process and practices.

Mandel is a member of the Steering Committee of The Sedona Conference Working Group 1, and has worked on a variety of leading papers for the organization. He also sits on the EDRM Advisory Board, and has led two key EDRM projects. Ragan was a partner at Pillsbury, Madison & Sutro and its successor firm for 25 years, and was the co-managing editor of the often-cited Sedona Principles (2004, 2005, and 2007 annotated versions). He is an author of several distinguished publications on E-Discovery and Information Governance, and a Certified Information Privacy Professional (CIPP/US). Ragan also serves as an adjunct professor on these areas of law at University of Minnesota and University of California Hastings law schools.

“I am pleased to join Zelle Hofmann and work with Eric to develop this practice. Zelle Hofmann is unique amongst firms its size in recognizing the value it can provide to clients through the combination E-Discovery and Information Governance legal services and the best of today’s technology,” said Ragan.
