Conversations between the Office of Raiser & Kenniff, and his client, were recorded, and presented in Court.

Steve Raiser, had this to say, "Attorney client privilege is so important, because it's one of the underpinning of our system. The fact is that there's an attorney client privilege phone call, the District Attorney is not supposed to use those communications. It's the same thing as if someone were to go in and speak to their priest."

Touro College law professor, Richard Kline, "Listening to an attorney client privilege conversation is absolute…that's not to be done. That's a serious violation that took place. I think that we have to make sure that occurrences like that don't happen."

In a response to accusations made by Steve Raiser, the Nassau County DA responded, "not all conversations with an attorney, or his employees, are privileged." Yet the DA failed to indicate how in this particular case it fell outside of that privilege.
