NORTH HALEDON, NJ--(Marketwired - March 04, 2014) - The Digital Right to Repair Coalition (DRTR) this week said it hopes the conclusion of the long-running legal battle between independent telecom maintenance and service provider, Continuant (www.continuant.com), and telecom giant, Avaya, will open the door to competition for the lucrative after-warranty maintenance market for certain kinds of digital equipment.
"If the jury finds against Avaya -- and we believe they will -- we expect important precedent to be set supporting the rights of equipment owners to select the repair provider of their choice," said Gay Gordon-Byrne, DRTR Executive Director. She added, "From the start, this case has been about challenging the monopoly on user support and repair based on 'embedded software' access. We are hopeful that a win by Continuant would be a win not just for independent repair and support companies but also for consumer who will benefit from increased competition in the marketplace."
Gordon-Byrne added, "This case is going to provide much-needed clarity on how software created for maintenance and settings controls can be used legally outside the hands of the vendor. Owners will know that it is legal for them to self-support, or to hire independent technicians as they see fit. The threat of litigation for using service passwords will be removed and there will be healthy competition as a result. There are many other subtle points all of which support the rights of equipment owners to control their own support, which we believe are broadly applicable."
