San Francisco, CA – Wage and hour laws in California can be confusing for many employees to understand. When trying to dissect the law for clarity on what their rights are regarding matters such as minimum wage, overtime pay, vacation time and pay, sick leave, and recovering unpaid wages, many employees become frustrated with the language.
In a recent interview, California wage and hour law expert Eric Grover discussed common areas where employees may misinterpret the law or run into challenges in understanding their legal rights and options for standing up to employers who commit related violations.
When asked about the three most common employment law violations committed by employers today, Grover identified them as:
Misclassifying employees as independent contractors
And minimum wage violations
According to Eric Grover, a number of California workers are misclassified as independent contractors by companies that try to save costs associated with employment taxes and employee benefits. Some also try to get away with putting the cost of doing business on "contract workers," such as truck drivers, who are forced to pay costs associated with operating their vehicles and end up barely making minimum wage when the numbers are added up. The San Francisco based wage and hour attorney also noted that California carries the strictest overtime laws in the country, and many employees are not aware that they are entitled to overtime pay if they work more than 8 hours a day, even if they work less than 40 hours per week.
